Terms of Service

1. Agreement to Terms

By engaging BUILDERNESS for any service — whether in person, remotely, or through our website at thebuilderness.com — you agree to the following terms and conditions. If you do not agree, do not proceed with service.

2. Scope of Services

BUILDERNESS provides IT support, device repair and maintenance, network setup, data recovery, and digital legacy planning services to individuals and small businesses in Downeast Maine and remotely. Services are provided on a per-engagement basis unless a retainer agreement is in place.

3. Data Responsibility

Preserving your data is your responsibility. Before any work begins on your device or accounts, it is strongly recommended that you maintain a current backup of all data — including documents, photos, passwords, software license keys, and any other stored information.

In the course of service, data loss can occur. This includes, but is not limited to:

  • Hardware failure during diagnostics or repair
  • Software conflicts, resets, or OS reinstallation
  • Corruption discovered during recovery attempts
  • Actions taken at your direction

BUILDERNESS is not liable for any loss of data, files, configurations, or functionality for any reason. If you would like us to perform a backup before we begin work, please request this in advance. Additional fees may apply.

4. Virus, Malware, and Security Work

There is no warranty on virus, spyware, adware, or malware removal. If symptoms return or reinfection occurs, service fees will apply again. We will advise on preventative measures, but ongoing protection is the responsibility of the client.

5. Physical Damage and Pre-Existing Conditions

Devices showing signs of prior liquid damage, physical trauma, or severe wear may be exempt from any warranty offered. If such conditions are discovered during service, we will cease work and contact you before proceeding. Authorization from you is required to continue.

We are not responsible for pre-existing faults discovered during unrelated service.

6. Authorization and Consent

By handing over a device or granting remote access, you authorize BUILDERNESS to perform the agreed-upon service. You confirm that you own the device or have authorization from the owner to request service. Unauthorized requests for access to third-party accounts, devices, or data will not be fulfilled.

7. Remote Access

Remote support sessions are conducted with your knowledge and active consent. Sessions may only be initiated by you. BUILDERNESS will not initiate unsolicited remote connections to your device. You may terminate any session at any time.

8. Digital Legacy Planning Services

Digital legacy planning engagements involve the review, organization, and documentation of your digital accounts, assets, and instructions. This work is advisory and organizational in nature. BUILDERNESS does not access, modify, or transfer accounts without your explicit written authorization for each action.

Clients are responsible for the accuracy of information provided and for keeping their own records current. BUILDERNESS is not responsible for changes made by third-party platforms to their account policies, access requirements, or service availability.

9. Estimates and Pricing

Any estimate provided before service begins is not a guaranteed final price. If the scope of work changes or unexpected complications arise, we will contact you before proceeding with additional billable work. Work will not exceed an agreed estimate by more than 20% without your explicit approval.

10. Payment

Payment is due upon completion of service unless otherwise agreed in writing. BUILDERNESS reserves the right to retain possession of a device until payment is received. Unpaid balances beyond 30 days may be subject to late fees.

11. Warranty on Repairs

Where a warranty is offered, it applies to the specific repair performed and does not cover:

  • New or unrelated failures
  • Physical damage occurring after service
  • Damage caused by liquid, power surges, or user error
  • Devices with pre-existing liquid or physical damage
  • Virus or malware reinfection

Warranty terms will be stated explicitly at the time of service.

12. Limitation of Liability

BUILDERNESS's total liability for any claim arising from services rendered shall not exceed the amount paid for that specific service. We are not liable for indirect, incidental, or consequential damages of any kind.

13. Right to Refuse Service

BUILDERNESS reserves the right to refuse or discontinue service at any time, at our discretion.

14. Changes to These Terms

These terms may be updated at any time. The most current version will always be available at thebuilderness.com/terms. Continued use of our services constitutes acceptance of any updated terms.
